Why does probate take so long?

One of the biggest frustrations families have with probate is the amount of time it can take. In New Hampshire, an estate cannot be closed until at least six months after the Executor or Administrator is appointed because creditors have that six-month period to file claims against the estate.

Probate is not designed around getting money or property to the family as quickly as possible. Regrettably, the process is designed to make sure the estate is handled carefully — assets are identified, valid debts and expenses are addressed, and creditors have an opportunity to make claims. Only then can the remaining estate be distributed to the heirs or beneficiaries.

That can be difficult for families who are already grieving and understandably want everything settled. Unfortunately, even when an estate is straightforward and everyone agrees, there are still timelines and legal requirements that have to be followed.
